Why Are Single-Use Vapes Banned in the UK?

Hayati Pro Max Plus 6000 Puff Prefilled Pod Kit – image 7

Since 1 June 2025, it has been illegal to sell or supply single-use vapes anywhere in the UK – England, Wales, Scotland and Northern Ireland. If you have wondered why these products disappeared from shop shelves, and what you can still legally buy, this guide explains it in plain English.

What exactly is banned?

The ban covers vapes that are not refillable and have a battery that cannot be recharged – the kind you use until it runs out and then throw away. It applies to sales in shops and online, and it applies whether or not the vape contains nicotine.

Vaping itself is not banned. Rechargeable, reusable devices are still legal to buy and sell for adults aged 18 and over.

Why did the UK ban single-use vapes?

1. Waste and the environment

The government’s announcement cited research estimating that almost five million single-use vapes were being littered or thrown away in general waste every week in the UK – nearly four times more than the year before. In 2022 alone, more than 40 tonnes of lithium from these devices was thrown away. Lithium and other materials in batteries are valuable and hard to recover once they end up in landfill.

2. Fire risk

Lithium-ion batteries thrown into household bins can be crushed in bin lorries and at waste sites, which can start fires and put waste workers at risk.

3. Youth vaping

Government figures showed that around a quarter of 11–15-year-olds had used a vape in the previous year, and that cheap single-use products were the type most children who vape were choosing. Removing them was one part of a wider plan to stop vapes reaching under-18s.

What can adults still buy legally?

Product Legal to sell? Why
Single-use vapes (not rechargeable, not refillable) No Banned since 1 June 2025
Prefilled pod kits with a rechargeable battery Yes The battery is reused; only the pod is replaced
Refillable pod kits Yes Rechargeable and refillable with e-liquid
Nic salts, e-liquids and shortfills Yes For use in refillable devices (TPD rules still apply)
Replacement pods and coils Yes Parts for reusable devices

How to check a vape is legal

  • Rechargeable: it has a charging port (usually USB-C).
  • Reusable: the pod can be swapped or refilled, so the battery is used again.
  • UK compliant: tanks and prefilled pods hold no more than 2ml, nicotine strength is no higher than 20mg/ml, and the pack carries the UK health warning.
  • Sold to adults only: a legitimate UK seller will always check you are 18+.

What happens to shops that break the rules?

The ban is enforced by the Office for Product Safety and Standards and local Trading Standards teams. Businesses that sell or supply banned products can face fines or prosecution. Retailers must also still offer a take-back scheme for old vapes under the UK’s waste electrical (WEEE) rules. Shop owners can read our UK vape rules for shops.

What else is changing? The Tobacco and Vapes Act 2026

The single-use ban was only the first step. The Tobacco and Vapes Act 2026 received Royal Assent on 29 April 2026. For vapes, it:

  • confirms the ban on selling vapes to anyone under 18;
  • bans selling vapes through vending machines;
  • controls the advertising and promotion of vapes;
  • allows a licensing scheme for shops that sell vapes and tobacco;
  • gives the government powers to set rules on vape flavours, packaging and display through future regulations.

Many of these rules come in stages. See our guides to the Tobacco and Vapes Act changes and UK vape rules in 2026 for the latest dates.

How to get rid of old vapes

Never put vapes or batteries in your household bin. Take them to a small electricals recycling point at your local tip, or return them to a shop that sells vapes – most are required to take them back.

FAQs

Are vapes banned in the UK?

No. Only single-use vapes (not rechargeable and not refillable) are banned. Rechargeable and refillable vapes remain legal for adults aged 18 and over.

When did the single-use vape ban start?

1 June 2025, on the same day across England, Wales, Scotland and Northern Ireland.

Are prefilled pod kits legal?

Yes. A prefilled pod kit has a rechargeable battery that you keep and reuse; you only replace the pod when it runs out.

Is it illegal to use a single-use vape I already own?

The ban applies to selling and supplying them. When it runs out, recycle it properly rather than putting it in the bin.
