UK cigarette and tobacco law is going through its biggest change in a generation. From 1 January 2027, anyone born on or after 1 January 2009 will never be able to legally buy tobacco in the UK. This guide explains the new “smokefree generation” rule and the cigarette laws that already apply, for adults and for shop owners.
The smokefree generation rule (from 1 January 2027)
The Tobacco and Vapes Act 2026 received Royal Assent on 29 April 2026. Its headline change is a rising age of sale for tobacco:
- It will be illegal to sell tobacco products – including cigarettes, rolling tobacco and cigars – to anyone born on or after 1 January 2009.
- Because the cut-off is a date of birth, not an age, this group will never be able to buy tobacco legally, even as adults.
- People who can already buy tobacco legally keep that right.
- It will also be an offence for an adult to buy tobacco on behalf of someone born on or after 1 January 2009 (a “proxy purchase”).

Cigarette laws that already apply in the UK
- Age of sale: you must be 18 or over to buy tobacco, and it is illegal for an adult to buy tobacco for someone under 18.
- Smoke-free public places: smoking is banned in enclosed public places and workplaces, including pubs, restaurants, shops and offices, across all four UK nations.
- Smoking in cars with children: in England and Wales it is illegal to smoke in a private vehicle when anyone under 18 is present.
- Plain packaging: cigarettes and rolling tobacco must be sold in standardised drab-green packs with large picture health warnings.
- Minimum pack sizes: cigarettes come in packs of at least 20, and rolling tobacco in pouches of at least 30g.
- Menthol ban: cigarettes and rolling tobacco with a characterising flavour, such as menthol, cannot be sold.
- Display ban: shops must keep tobacco out of sight behind closed units.
- Advertising ban: tobacco advertising and sponsorship are banned.
- No vending machines: tobacco cannot be sold from vending machines.
What it means for shops
If you sell tobacco, the new rules make age checks even more important:
- Check ID by date of birth, not just age. From 2027 the key question is whether the customer was born before 1 January 2009.
- Train staff on the new rule and on refusing proxy sales.
- Keep a refusals log – it helps show you took all reasonable steps.
- Expect enforcement: Trading Standards can issue fixed penalty notices (£200 for age-of-sale and proxy-sale offences), and a future licensing scheme will add stricter penalties.

Does the new law affect vapes?
Yes, but differently. The smokefree generation rule applies to tobacco. For vapes and other nicotine products, the minimum age stays at 18, and the Act adds rules on vending machines, free samples, advertising, and future powers over flavours and packaging. Single-use vapes have been banned since 1 June 2025 – see why single-use vapes are banned in the UK.
FAQs
Are cigarettes being banned in the UK?
No. Adults who can legally buy tobacco now will still be able to. The change stops sales to anyone born on or after 1 January 2009, so the number of people who can legally buy tobacco gets smaller over time.
When does the smokefree generation law start?
The age-of-sale change for tobacco is due to start on 1 January 2027.
Can I buy cigarettes for a younger friend or relative?
No. Buying tobacco for someone under 18 is already illegal, and from 2027 it will also be an offence to buy it for anyone born on or after 1 January 2009.
Does the rule apply to vapes?
No. The birth-date rule is for tobacco. Vapes and nicotine products stay 18+.

Tobacco, vapes and nicotine products are for adults aged 18+ only. Nicotine is a highly addictive substance.
